Former Attorney General of Louisiana, Charles C. Foti, Jr., Esq., a partner at the law firm of Kahn Swick & Foti, LLC (“KSF”), announces that KSF has commenced an investigation into Krispy Kreme, Inc. (“Krispy Kreme” or the “Company”) (NasdaqGS: DNUT).

On October 26, 2022, the Company commenced a small-scale test to offer doughnuts at McDonald’s Corporation (“McDonald’s”) restaurants in Louisville, Kentucky, and the surrounding area. On March 26, 2024, the Company and McDonald’s announced that they would expand the partnership nationwide beginning in the second half of 2024. On February 25, 2025, the Company reassured investors regarding the growth opportunities of the partnership and the potential profitability of the U.S. national rollout, and “remain[ed] on track to reach about 6,000 restaurants by year end.”

However, on May 8, 2025, the Company disclosed that it was pausing the McDonald’s rollout—the centerpiece of its U.S. growth strategy. The Company announced that it was “reassessing the deployment schedule together with McDonald’s while it works to achieve a profitable business model for all parties and does not expect to launch in any additional restaurants in the second quarter of 2025.” The Company further disclosed that, as of March 30, 2025, Krispy Kreme doughnuts remained available in just over 2,400 McDonald’s restaurants, effectively unchanged from the total reached on February 25, 2025, revealing that the expansion had stalled almost immediately after it assured investors that it was on track.

Thereafter, the Company and certain of its executives were sued in a securities class action lawsuit, charging them with failing to disclose material information during the Class Period in violation of federal securities laws, which remains ongoing.

KSF’s investigation is focusing on whether Krispy Kreme’s officers and/or directors breached their fiduciary duties to its shareholders or otherwise violated state or federal laws.
