KSF Defeats Motion to Dismiss in NCAA Data Privacy Litigation

On March 25, 2026, the Hon. Michelle Williams Court, United States District Judge  for the Central District of California, denied in full Defendants National Collegiate Athletic Association and Turner Sports Interactive’s motion to dismiss a data privacy class action complaint. Plaintiffs, represented by KSF, allege that Defendants, who own and operate the website NCAA.com,  which features live video, scoring, ranking, news, and statistics for all college sports across all NCAA divisions, installed trackers on the website that surreptitiously collect and share with third parties – including data brokers – users’ personal information for targeted advertising purposes. As such, Plaintiffs allege that Defendants have violated the pen register provision of California’s Invasion of Privacy Act. Judge Court denied Defendants’ motion to dismiss in full, finding that Plaintiffs have standing based on the alleged collection and dissemination of their information, that such conduct falls within the scope of the statute, and that Plaintiffs adequately pled their claims.
