On August 23, 2021, the Hon. Lorna G. Schofield, United States District Court Judge for the Southern District of New York, entered an Opinion and Order substantially denying defendants’ motion for summary judgment, holding a reasonable jury could find that 15 of 16 challenged statements about the performance of, and accounting relating to, CB&I’s nuclear business were (1) false and misleading or (2) made with scienter.
