On December 2, 2021, the Hon. Carolyn B. Kuhl, Judge of the Superior Court of the State of California for the County of Los Angeles, entered an Opinion and Order denying in its entirety defendants’ demurrer to (or motion to dismiss) plaintiffs’ consolidated complaint, holding that plaintiffs adequately alleged claims that may be asserted directly (rather than derivatively) and that those allegations were sufficient to state claim for breach of fiduciary duties in connection with the acquisition of Anworth Mortgage Asset Corporation.
