Kahn Swick & Foti, LLC filed an ERISA class action complaint on October 7, 2026, against HP Inc., the HP Plan Committee and its members in the United States District Court for the Northern District of California on behalf of participants and beneficiaries of the HP Inc. 401(k) Plan. Plaintiffs allege that defendants breached their fiduciary duties by, among other things, adopting an imprudent process for evaluating and monitoring investment options, engaging in prohibited transactions, and failing to adequately monitor the administration and management of plan investments. Plaintiffs seek over $313 million in alleged damages, as well as lost opportunity costs.
