KSF filed an ERISA class action complaint on January 28, 2026, against Dell Technologies, Inc. and certain of its officers and directors in the United States District Court for the Western District of Texas on behalf of participants and beneficiaries of the Dell Inc. 401(k) Plan. Plaintiffs allege that defendants breached their fiduciary duties by, among other things, failing to divest underperforming investment options, engaging in transactions prohibited by ERISA, and failing to adequately monitor the administration and management of plan investments. Plaintiffs seek over $318 million in alleged damages, as well as lost opportunity costs.
