KSF Files a Derivative Stockholder Complaint Against Rivian Automotive
On July 10, 2026, Kahn Swick & Foti, LLC filed a derivative stockholder complaint against Rivian Automotive, Inc. and certain of its current and former officers and directors in the Delaware Court of Chancery. Plaintiff alleges that defendants breached their fiduciary duties by, among other things, causing or permitting Rivian to make false and misleading statements regarding customer demand, the reliability of the Company’s preorder backlog, and its ability to achieve its financial targets, engaged in insider trading as well as other misconduct, and unjustly enriched themselves at Rivian’s expense. Plaintiffs seek restitution and compensatory damages to Rivian, disgorgement of improperly obtained profits and other monetary gains by the individual defendants, and corporate governance reforms.
