KSF filed an amended ERISA class action complaint on July 9, 2026, against Dell Inc., Dell Technologies, Inc., and certain of their officers and directors in the United States District Court for the Western District of Texas on behalf of participants and beneficiaries of the Dell Inc. 401(k) Plan. Plaintiffs allege that defendants breached their fiduciary duties by, among other things, failing to divest underperforming investment options, engaging in transactions prohibited by ERISA, and failing to adequately monitor the administration and management of plan investments. Plaintiffs seek over $270 million in alleged damages, as well as lost opportunity costs.
